✅ Acceptance of Terms

By placing an Order or browsing the Site, you confirm that you have read, understood, and agree to these Terms, including our Returns Policy outlined below. If you do not agree, please do not use our Site or purchase our Products.

🛒 Ordering and Contract Formation

• Placing an Order: When you place an Order, you offer to buy the Products subject to these Terms. All Orders are subject to acceptance by us
• Confirmation: We will email you an Order confirmation. A contract is formed when we send you a dispatch confirmation email
• Availability: Product availability is subject to change. If a Product is unavailable after you place an Order, we will notify you and refund any payments made

📦 Product Information

We endeavour to display product images and descriptions accurately. However, actual colours and specifications may vary slightly. Technical specifications are subject to manufacturer tolerances.

💷 Pricing and Payment

• Prices: All prices are shown in GBP (£) and include VAT where applicable. Delivery charges are additional and calculated at checkout
• Payment: We accept payment via major credit/debit cards, PayPal, and other methods displayed at checkout. Payment is taken at the time of ordering
• Errors: In the event of a pricing error on our Site, we reserve the right to cancel Orders or contact you to obtain your instructions

🚚 Delivery

• Shipping Options: We offer standard and expedited shipping within the UK and internationally. Estimated delivery times are provided during checkout
• Risk and Title: Title to Products passes to you once they leave our warehouse. You assume the risk of loss upon delivery

↩️ Returns and Refunds Policy

Our Returns Approach:

• Seller Errors: If we supply incorrect goods due to our error or a manufacturer/supplier mistake, we will gladly accept returns at no cost to you. We'll cover return shipping and provide a full refund or replacement
• Customer Ordering Errors: Returns are not accepted for goods incorrectly ordered by the customer where the Vehicle Identification Number (VIN) and vehicle registration were not provided at the time of purchase. It is your responsibility to ensure the correct parts are ordered

Discretionary Returns (Special Circumstances):

In exceptional cases, we may, at our sole discretion, agree to accept a return not otherwise covered under this policy. If we approve such a discretionary return:

• A restocking fee of 65% of the original item cost will apply
• This fee covers our costs for inspection, repackaging, inventory management, and ensuring the part remains suitable for resale to another customer
• Original shipping and handling fees are non-refundable
• Return shipping costs are the customer's responsibility unless otherwise agreed in writing
• Items must be unused, in their original packaging with all labels intact, and in pristine, resaleable condition

UK Consumer Rights (Statutory Returns):

• 14-Day Cooling-Off Period: Under UK Distance Selling Regulations, you have the right to cancel your order within 14 days of receiving the Products for a refund (excluding original delivery costs)
• Condition Requirements: Products must be unused, in original packaging, and in resaleable condition to qualify for a refund under consumer protection laws
• Faulty or Damaged Items: If you receive faulty, damaged, or incorrect items due to our error, contact us within 14 days for a full refund or replacement. We will cover return shipping costs for our errors

Return Authorization Requirements:

• All returns must be authorized in advance - contact us within 7 calendar days of delivery to request authorization
• Do not return items without prior authorization as they will be rejected and returned to you at your expense
• Items must be completely unused, in original packaging with all labels, manuals, and accessories intact
• Prior to authorization, we may require photos or other evidence of the item's condition

Non-Returnable Items (No Exceptions):

• Electrical components - for safety, reliability, and regulatory reasons
• Special order items - parts ordered specifically for you or custom-ordered from manufacturers
• Fitted, used, opened, or damaged items - once installed, opened from packaging, or showing any signs of use or installation attempts, parts cannot be returned
• Items damaged due to improper installation or use

Non-Refundable Charges:

• All original shipping and handling fees are non-refundable - these cover actual costs incurred
• Return shipping costs are the customer's responsibility unless the return is due to our error
• Payment processing fees are non-refundable

All content on the Site—including text, graphics, logos, and images—is our property or licensed to us and protected by UK and international intellectual property laws. You may not reproduce or use any content without our written permission.

⚖️ Limitation of Liability

To the maximum extent permitted by law, Performance HQ's liability for any claims arising out of or related to the Site or Products is limited to the purchase price of the affected Products. We shall not be liable for indirect, incidental, or consequential losses.
